Terms of service

These terms are an agreement between you and Partytape for using our website, guest pages and apps (the “Service”). By hosting an event or joining one as a guest, you agree to them. If you don’t agree, don’t use the Service. Our privacy policy explains how we handle information.

Who can use Partytape

  • The Service is available in the United States only.
  • Hosts must be at least 18 and able to form a binding contract. Guests must be at least 13.
  • You’re responsible for activity under your host account and for keeping access to your email secure.

Hosts

  • You decide who receives your event link and QR code, and you’re responsible for telling attendees that the event may be filmed.
  • You must have the right to film at your venue and must not use Partytape where recording is prohibited or where people have a reasonable expectation of privacy (for example restrooms or changing areas).
  • If children will attend, mark the event as a kids’ event. Children should not join as guests; adults film the event.
  • You control the gallery and reveal settings and can hide or delete any upload. Please act promptly on removal requests from people who appear in footage.

Guests

  • Only upload content you captured at the event and have the right to share.
  • By uploading, you agree the host can view, keep, download and share your uploads and the films and reels made from them.
  • You can delete your own uploads from the event page at any time before the event is archived. Content already included in a delivered film may remain in that version.

Your content and our license

You keep ownership of what you upload. You grant Partytape a worldwide, non-exclusive, royalty-free license to host, store, process, analyse, edit, combine, render and display your content solely to operate and improve the Service for that event, including creating films and reels and delivering them to the host and, where applicable, to you. This license ends when the content is deleted, except for copies kept for a limited time in backups or as required by law. We do not use your photos or videos to advertise Partytape without your permission.

Acceptable use

Don’t upload or use Partytape to share content that:

  • is sexually explicit, depicts or sexualises minors, or is violent, hateful or harassing;
  • infringes someone else’s rights, including copyright and privacy;
  • was recorded without consent where consent is required by law.

Don’t try to access events you weren’t invited to, interfere with the Service, scrape it, or reverse engineer it. We screen uploads automatically and may remove content, end events or close accounts that break these rules. We report apparent child sexual abuse material to the National Center for Missing & Exploited Children.

Plans and payments

  • The Free plan covers events up to 15 guests. The Party plan is a one-time payment per event. Host Pass is a yearly subscription that renews automatically until cancelled; you can cancel any time from your account and keep access until the end of the paid year.
  • Payments are processed by Stripe. Prices are in US dollars and may change for future purchases.
  • If a film isn’t delivered for a paid event because of a problem on our side, contact us and we’ll refund the plan. Otherwise one-time plans are non-refundable once guests have joined the event.
  • Re-rendering a film after edits is free.

Films, music and availability

Films are generated automatically and quality depends on what guests capture. We aim to deliver films by the morning after an event but don’t guarantee timing. Music in films is licensed for personal sharing of that film; you may not extract the music or use films commercially without our written permission.

We keep event media for 12 months after the event, then delete it unless you’ve arranged extended storage. Download anything you want to keep.

Disclaimers and liability

The Service is provided “as is”. To the fullest extent permitted by law, Partytape disclaims implied warranties of merchantability, fitness for a particular purpose and non-infringement, and is not liable for indirect, incidental, special, consequential or punitive damages, or for lost content beyond our obligation to use reasonable care. Our total liability for any claim is limited to the greater of the amount you paid us in the 12 months before the claim or $100. Some states don’t allow these limits, so they may not apply to you.

You agree to indemnify Partytape against claims arising from content you upload or events you host in violation of these terms.

Disputes

These terms are governed by the laws of the State of Delaware, without regard to conflict-of-law rules. Before filing a claim, contact us at support@partytape.app so we can try to resolve it informally within 60 days. Either party may bring qualifying claims in small claims court.

Changes and termination

We may update these terms; if a change is material we’ll notify hosts by email before it takes effect. You can stop using Partytape at any time, and hosts can delete their account from the app or dashboard. We may suspend or end access for violations of these terms.
